Monthly Board Meeting: was called to order at 6:08 pm by Supervisor John Kraus, Jr.

Minutes from the February 14, 2007 Board Meeting were approved as presented with a
motion from John Kraus, Jr., seconded by Carole Garczynski.
Treasurers Report: The Treasurers Report for $85,148.61 was approved as presented
with a motion from John Kraus, Jr., seconded by Carole Garczynski. A full report is on

Letter of Intent Submitted by Leroy Kranz to Create a 15-acre Parcel and a 43.8-Acre
Parcel from an Existing 58.8-acre Parcel at W10149 County Highway“S”:
Supervisor Kraus asked Planning Committee Chairman John Wedel for their findings.
Mr. Wedel reported that the committee viewed the land division on Monday March 12th
and the committee recommends that the land division be approved at a decreased size
of 100’from the bunker silo and 150’from the corn crib, a“Right to Farm”statement
and a deed restriction on the remaining parcel that there be no further land divisions.
Supervisor Kraus asked the floor for comments in favor of this land division:
Mr. Leroy Kranz stated that he couldn’t see what the difference was with 300’going with
Realtor Tina Swain stated to the board that the offer to purchase is for 15 acres as the
buyer has multiple horses and needs the land, and cannot afford the whole parcel. She
also stated that there is an offer on the remaining agricultural land from someone that
intends to farm it. She asked the board where in the land use plan it states that the land
division can only have 100’from the buildings.
Supervisor Kraus explained that 11.4, page 68, policy recommendations is to“Minimize
the amount of land associated with farmettes which occurs as a result of farm
consolidation.”Supervisor Kraus continued that this has been the policy of the board in
the past and it is the intention of the board to remain consistent.
Supervisor Kraus asked the floor for comments against this land division:
Altine Graper, an adjoining land owner, expressed concerns with the field road that
follows along side the property line as it is the only access for a number of her fields.
Her concern is that the there are no problems in the future with keeping this access and
she would like some kind of guarantee to that effect.
Supervisor Kraus asked Mr. Kranz if he would like the board to consider the land division
as submitted, with the full 15 acres, or as the Planning Committee recommended. Mr.
Kranz replied that he wishes the board to consider the original Letter of Intent.
After discussion, Supervisor Kraus made a motion, seconded by Carole Garczynski to
deny this land division request based section 11.4 of the Land Use Plan policy
recommendations, but to allow the land division as presented by the Planning
Committee, which is to divide the buildings with the minimum of land, with a“Right to
Farm”statement, and Agriculture Use Only restriction and no further land divisions on
the remaining parcel. Call of Votes: John Kraus, Jr. aye, Carole Garczynski aye, motion
Adopt the Comprehensive Plan, Public Participation Plan: Supervisor Kraus explained
that the board read the plan at the last monthly meeting and Carole Garczynski made a
motion, seconded by John Kraus, Jr., to adopt the plan as drafted. Motion carried by
Cemetery and Town Hall Mowing for the 2007 Season:
A motion was made by John Kraus, Jr. seconded by Carole Garczynski to table the
decision until the April board meeting.
Set Date and Agenda for Annual Meeting:
The Annual Meeting of the Electors will be the second Tuesday in April, April 10, 2007
to begin at 6:00pm.
Supervisor Kraus stated that there is a problem with standing water in the cul-de-sac of
Cousins Court. He continued that after viewing the site he recommends that a culvert be
placed under the service drive at the end of Cousins Court and Wilke’s driveway.
Supervisor Garczynski noted that she had stated that a culvert should have been
installed in the Wilke drive but that the contractor felt is was not necessary. She
confirmed that article 10 of the Driveway Ordinance was noted on the original driveway
Supervisor Kraus asked the clerk to mail a letter to Wilke and Millers Woods
development to respond within two weeks about placing a culvert in the their respective
drives to alleviate this water problem.
Supervisor Kraus stated that he spoke with Attorney Lan Waddell regarding the clean up
of the Don Bleich property on Van Buren Road and that with the Order for Judgment
and Default Judgment and the Notice of Failure to Abate the town can enter his
property to clean it up. He felt that the board should give Mr. Bleich a five-day notice,
though it is not required, to allow him time to remove anything of value. He continued
that the cost will be the responsibility of the town, however it could be placed as a
charge on the property tax. He also instructed the board that in no way should any
items become the property of any board member. After further discussion Supervisor
Kraus instructed Supervisor Garczynski to contact Tim Fletcher for an estimate of cost
and time for the clean up.
Treasurer Marian Haas asked the board for direction regarding the Delinquent Personal
Property for Jim Salzman, as well as Jason Nehring and the $10.00 charge for a stopped
check from Shelby Jackson. She continued that she has left messages with those that
she has numbers for and has sent letters in the mail, with no response. The board
instructed Treasurer Haas to send letters by certified mail.
