Discussion/decision on the lawsuit pending with Donald Bleich, Jr. and a Resolution to order
the clean up of property at N5549 Van Buren Road owned by Donald Bleich, Jr.:
Attorney Lan Waddell informed the board that the lawsuit has been filed and served
against Donald Bleich, Jr. and he has not responded to the court. It is hoped that the judge can
order him to clean up the property.
Mr.Waddell talked with Wisconsin Towns Attorney Rick Stadelman who stated that
there is a case history from this summer that can be our precedence.
Mr.Waddell continued that the State provides a means for the Towns to issue a Raze
Order and hopefullyMr. Bleich, Jr. will clean up the property. If not the state allows the
towns authority to clean the property up and the cost then may: 1, be placed as a lien on the
property, or 2, can issue a court order to amend the pleadings to include the raze order with
the penalties of clean up placed as a special assessment tax on the property, which would
provide a better possibility of the town recouping some of the costs.
Mr.Waddell continued that Mr. Stadelman thought that by placing the lien holder on
the raze order notice that the lender would call on Mr. Bleich, Jr. to clean up the property.
Mr.Waddell presented the resolution and 30 day notice of raze order
A motion was made by John Kraus, Jr., seconded by Carole Garczynski to approve
the resolution and to serve the raze order on Donald Bleich, Jr., and National Exchange Bank
as lien holder for the building at N5549 Van Buren Road which is unfit for use. Call of
votes: John Kraus, Jr. aye, Carole Garczynski aye, John Kirchberg aye, motion carried.
Supervisor Carole Garczynski will laminate the Notice of Unfitness for Use and post
on the building at N5549 Van Buren Road on October 19, 2006.
Being no further business, a motion to adjourn was made by John Kirchberg,
seconded by John Kraus, Jr., carried by unanimous vote.Meeting adjourned at 7:03pm
