Monthly Board Meeting: was called to order at 7:08pm by Chairman John Kirchberg

Minutes from the June 13, 2006 Board Meeting were approved with the name correction
of Merfeld on page 82 with a motion from John Kraus, Jr., seconded by Carole
Garczynski.
Treasurers Report: The Treasurers Report for $41,954.67 with $100,000.00 in a
Certificate of Deposit until November 8, 2006 was approved as presented with a motion
from John Kirchberg, seconded by John Kraus, Jr. a full report is on file.
Floor was opened for questions or comments on Non-agenda items:
Harold Stelter asked if there was something the board could do about the
fireworks as they are getting out of hand. He expressed concerns with the dry marsh or
his barn starting on fire as well as concerns that his cows might bust out because they
were scared. Chairman Kirchberg stated that he’d talk to the Sheriff Department but
that there was probably nothing they would do after the incident. Mr. Kirchberg stated
that the town does not issue permits to allow a fireworks display, therefore, they are
illegal and directed Mr. Stelter to call the Sheriff while they are being fired.
Mr. Stelter then asked why there are two outlets selling fireworks in Calamus?
Chairman Kirchberg explained that under county zoning they are permitted by Dodge
County.
Barb Schneider stated to the board that at the last annual meeting she was
concerned with the fact that no raise was given to the board. She stated that she was
not able to attend and understands the turnout was low and she felt that it was
important to reconsider. Mrs. Schneider asked that the board find out the procedure to
bring this issue back for review.
Agenda:
Letter of Intent Submitted by James White to Create an Approximate Three-acre Parcel
with the Existing Homestead and a 137-acre Parcel from an Existing 140-acre Parcel at
W11002 Kleindl Road:
Planning Committee chairman Scott Steers stated that Ken Schreiber abstained because
of a possible conflict of interest. Mr. Steers read the Dodge County Staff Report, which
stated“The request is in conformance with the Town Land Use Plan, since the area is
designated as Farms and Farmsteads. However the proposal dos not meet the Town’s
lot depth, lot access, and width of lots requirements. The proposal does not meet the
County’s requirements for public road frontage or lot width. Also, the creation of the
proposed lot will create a non-conforming lot, since the parent parcel will not abut a
public road.”Mr. Steers stated that the committee recommends the board approve this
division, as there is no change of land use, provided Mr. White can obtain approval from
the County regarding the public road frontage, without the current driveway becoming a
public road. Also the committee recommends that both parcels have a deed restriction
to not allow any further divisions.
Chairman opened the floor for anyone to speak to the board regarding this division, with
no response.
After much discussion, noting that the current parcel does not have adequate public
road frontage to provide the needed frontage for the division, a motion was made by
John Kirchberg to approve this land division request with a“Right to Farm”statement
and a deed restriction that there be no further building on the parent parcel, that the
driveway onto the homestead property be the same width as Kleindl Road, that there be
a deed restriction of no further land divisions on both parcels, as well as a field driveway
installed at the end of Kleindl Road for access to the parent parcel, allowing for a shared
driveway in for 20 feet if needed. John Kraus, Jr. made a second to the motion. Call of
Votes: all aye, motion carried unanimous.
Letter of Intent Submitted by Cary Hochstatter to Create an Approximate Eight-acre
parcel with the Existing Homestead and a 144-acre Parcel from an Existing 152-acre
Parcel at N5570 Lark Road:
Chairman Kirchberg asked that Planning Committee Chairman Scott Steers recuse
himself because of possible conflict as an adjoining landowner. Committee member John
Wedel read the Dodge County Staff report that stated,“The request is in conformance
with the Town Land Use Plan and Subdivision Ordinance. According to the application
and the application site diagram the proposed lot will not change the use of the land,
therefore staff recommends that the Town approve this division.”Mr. Wedel continued
that the committee recommends the board approve this division, as there will be no land
use change, with a“right to Farm”statement and a deed restriction of no further land
divisions or buildings on parent parcel.
Chairman Kirchberg opened the floor for comment, with no response.
A motion was made by John Kraus, Jr. to approve this division to include all buildings,
with a“Right to Farm”statement and a deed restriction that there be no further land
divisions on both parcels and no buildings allowed on parent parcel. John Kirchberg
made a second to the motion, call of votes: all aye, motion carried unanimous.
Discussions with Foth & Van Dyke regarding a Smart Growth Comprehensive Plan:
Jeff Retzlaff representing Foth & Van Dyke presented a“gap”analysis to bring our
current Land Use Plan compliant with the State of Wisconsin’s requirement for all
municipalities to have a“2030 Smart Growth Plan”in place by January 1, 2010.
After much discussion it was decided to have a resolution for approval at the August
board meeting to approve Foth & Van Dyke to submit a grant application on our behalf
for funding for a new plan.
Discussion/decision on the clean up of Donald Bleich Property on Van Buren Road:
Chairman Kirchberg provided a copy of certified mail dated July 6, 2006 from Dodge
County to Donald Bleich, Jr. to the board and Mr. Bleich. Clerk Beilke read the letter and
submitted into minutes (page 89)
After some discussion, a motion was made by John Kraus, Jr., seconded by Carole
Garczynski to issue an over-weight permit to Donald Bleich effective until July 31, 2006
for the purpose of removing all equipment at N5549 Van Buren Road as ordered by the
Dodge County Land Resource and Parks Department. Call of Votes: all aye, motion
carried unanimous.
Report from Driveway Inspector:
The fee for a Driveway permit for Mr. and Mrs. Earl Schalk, Jr. to blacktop their driveway
at N5663 State Road 73 was ordered returned as there was no significant change to the
driveway.

Other Business:
Chairman Kirchberg stated that there is junk in the road right of way from Lewke on
Kirchberg Road and Weishoff on Hartt Road. Clerk provided copies of the letters sent in
the past so it was decided to have attorney Lan Waddell pursue action.
The Board instructed Chairman Kirchberg to pursue action against mobile home
violations with Attorney Lan Waddell.
Bills: Bills for a total of $13,194.59 were approved as presented with a motion form John
Kirchberg, seconded by John Kraus, Jr.
