Minutes: John Kraus, Jr. made a motion, seconded by
Lucille Miller to approve the minutes from the August 12, 2003 Board Meeting
as presented.
Treasurers Report: A report for the total of
$154,292.56 was presented by Treasurer Marian Haas and approved as presented
with a motion from John Kraus, Jr., seconded by Lucille Miller. A full report
is on file.

Agenda:
Letter of Intent submitted by Gene and Audrey Benike
to create an approximate 10-acre, 12-acre, and two 80 acre parcels from an existing
186 acre parcel in the S _ of Section 33 and the NW _ and SE _ in Section 34
along County Trunk S and Ron-Del Road: Planning Committee Chairman
Scott Steers stated that the division is for the creation of three parcels as
the 12-acre parcel is on the other side of Ron-Del Road and therefore already
it’s own parcel. The Letter of Intent then would be to divide off the
existing buildings and split the remaining land into two 80-acre parcels. Mr.
Steers continued that this division is found to be in compliance with the town
land use plan and recommended approval with a “right to farm” statement
recorded as a deed restriction on the homestead parcel. Mr. Steers read the
county staff report prepared by Nate Olsen stating that the division is in conformance
with the Town Land Use Plan as well as the County Comprehensive Plan and therefore
the county recommends approval.
Chairman Kirchberg opened the floor for discussion. Del Yerges asked how come
they were not informed by a letter of this land division request. Clerk Beilke
replied that all adjoining landowners listed on the Letter of Intent form were
notified by mail, it is posted in the agenda and published in Daily Citizen
also, Chairman Kirchberg had talked to you (Mrs. Yerges) directly on the phone.
Mrs. Yerges expressed her concern for the increased traffic that this division
could create on the corner of Ron-Del Road and Hwy S.
Ron Yerges expressed concern that more acres will be divided up for more homes.
Mr. Benike stated that the land is currently enrolled in CRP and is considered
agricultural land, and would wish it to remain in its wild state.
John Wedel asked if the division is for agriculture, how could a house be built.
Chairman Kirchberg expressed concerns for the way the lines were drawn in right
angles and dividing all the fields. Floor was closed from discussion.
A motion was made by John Kirchberg to approve the land division requests with
the change of the boundary lines to follow the field lines, a “Right to
Farm” statement recorded on the deed for the parcel with the buildings,
a new field drive access for the field in lot 2 (south of homestead) and an
“agricultural Use Only” statement recorded on the two approximate
80-acre parcels. John Kraus, Jr. made a second to the motion. Call of voice
votes: all aye, motion carried.
Letter of Intent re-submitted by Mike Derr to create
an approximate 12-acre residential parcel from an existing 70-acre parcel in
the SE _, SW _ of Section 22 along N. Salem road: Planning Committee
Chairman Scott Steers stated that the concerns from the June board meeting had
been addressed. A letter signed in agreement with the majority of adjoining
landowners. As well as the concern for the placement of a driveway were addressed
in the letters from Ken Stock, Dodge County Highway Department and David Miller,
Excavator.
Mr. Steers continued that the area is listed as a “transition area”
on the land use map and the land is marginal for farming, and to make the parcel
smaller would not be sensible as the approximate 12-acres is surrounded by wetland.
Therefore the committee found the division to be in conformance with the town
land use plan, and recommended to the board approval, although they strongly
advised to place a five-year moratorium on the remaining agricultural land.
Chairman Kirchberg opened the floor for discussion. David Rake stated his approval
for the division as the land is set apart from the rest, not that good for farming
and would make a nice building site.
Scott Steers read a letter received from adjoining landowners Don and Nancy
Leuptow stating their disapproval of this division for the reasons of safety,
both regarding the site distance on N. Salem road as well as the hunting of
the surrounding property, open space for wildlife and town residents, and that
the purpose of the land use plan was to prevent land from being bought by outside
investors, divided and sold for residential sites.
Mike Derr stated that this proposed division is set apart from the rest of the
land and makes the most sense for a residential parcel. He has signed an affidavit
with Dodge County that there will be no further land divisions on the west side
of N. Salem. And that he will do the same for the remaining agricultural land
on this side.
John Kirchberg closed the floor from discussion and made a motion to approve
this land division on the conditions that an engineering plan acceptable to
the driveway ordinance be submitted and approved before the sale of the property,
a “Right to Farm” statement be recorded on deed of residential parcel,
An “Agricultural Use Only” statement be recorded on the remaining
agricultural land, and an affidavit filed with Dodge County allowing no further
land divisions on the east side of N. Salem, and an affidavit of “Agricultural
Use Only” on the remaining agricultural land on the west side.
Lucille Miller made a second to the motion, call of voice votes: all aye, motion
carried.
Discussion and decision with Beaver dam Conservationists
regarding reestablishing Burns Road: Dick Leistico asked if access
to their land could be established again. Currently the gun club members are
parking on County Highway DE and walk to the land. He stated that on the land
deed for Leroy Kirchberg the road is still established, and Dodge County has
no record of vacating road access. Mr. Leistico further stated that an aerial
from 1960 shows the road, and an aerial from 1971 shows that it is not there
but probably has been tilled. The Conservationists are looking for a one-lane
gravel road leading to a gated parking lot on their property. Chairman Kirchberg
stated that he will get a cost and asked Mr. Leistico if the Conservationists
are willing to pay for some of road. Clerk Beilke is to send a letter to Leroy
Kirchberg showing him the plans to re-open Burns road the full length to the
Conservationists property.
Discussion on Mobile Home Park Ordinance violations:
John Wendorf thanked the board for their display of compassion when dealing
with the ordinance violations at the mobile home parks.
Review of snowplow letter: Board approved
snowplow letter and fees, the same as last year. Clerk to send to last year’s
participants.
Annual review of employee wages:
With a motion from John Kirchberg, seconded by Lucille Miller, and carried with
a call of voice votes all aye, Effective October 1, 2003 all employee wages
to remain the same with the following exceptions:
Town Hall Manager salary $250.00 per year
Town Hall Inspection salary $150.00 per year
Town Hall cleaning hourly $11.50
Truck washing hourly $11.50
Winter Highway hourly $16.50
Summer Highway hourly $14.00
Grader Operator hourly $16.50
First Reading of the Town of Calamus Animal
Control Ordinance: Clerk Beilke read the changes made by the town attorney
Lan Waddell as the final draft and first reading of said ordinance. Supervisor
Kraus, Jr. asked clerk to post the Animal Control Ordinance on townofcalamus.com
Report from Driveway Inspector:
2 new driveway permits completed are Lueptow and Vick, approved existing drive
permit for Klapper at N6040 Hwy 151.
