Members Present: Chairman John Kirchberg, Supervisor 1 John Kraus, Jr., Supervisor 2 Lucille Miller, Clerk Marjorie Beilke, Treasurer Marian Haas.

Called to Order: at 7:04pm by Chairman John Kirchberg

Minutes: Being no corrections or additions, the minutes from the April 8, 2003 Board Meeting were approved as submitted with a motion from John Kraus, Jr., seconded by Lucille Miller

Treasurers Report: A report for the total of $120,192.75 was presented by Treasurer Marian Haas and approved as presented with a motion from John Kraus, Jr., seconded by John Kirchberg. A full report is on file.

Discussion and Decision on 2003 Road Projects and Bids:
After discussion and review of all bids, a motion was made by John Kraus Jr. to contract with Northeast Asphalt, Inc. to pulverize the existing pavement, fine grade, water and compact and install a 2" compacted average thickness hot mix binder course on Van Buren Road (Moriah Road to Mt. Pleasant) for a total of $53,368.20. John Kirchberg made a second to the motion. Call of votes: all aye, motion carried.

After discussion and review of all bids, a motion was made by John Kraus, Jr. to contract with Northeast Asphalt, Inc. to pulverize, fine grade, water and compact and install an average 2" hot mix binder course on Gunn Road (Jackson Road to Ridge Road) for a total of $43,487.90. John Kirchberg made a second to the motion. Call of votes: all aye, motion carried.

After discussion and review of all bids, John Kirchberg made a motion to contract with Northeast Asphalt, Inc. to install a leveling layer and a 1" compacted average thickness ultra-thin surface on Forest Road (Railroad tracks to North Town Line) for a total of $13,987.40. John Kraus, Jr. made a second to the motion. Call of votes: all aye, motion carried.

After discussion and review of all bids received, a motion was made by John Kraus, Jr. to contract with Crack filling Service, Inc. at $1.00 per pound applied, not to exceed the $4,000.00 budgeted amount, to start with all of Canary road, then Concord Road, east of Hwy 73, followed by East Salem Road from Lepple's to Hwy S, and, if budget allows, all of Robin Road. John Kirchberg made a second to the motion. Call of votes: all aye, motion carried.

After discussion and review of all bids received, a motion was made by John Kraus, Jr. to contract Michaels Materials at $10.25 per ton applied to shoulder all new pavement on Van Buren Road, Gunn Road, and Forest Road. Lucille Miller made a second to the motion. Call of votes: all aye, motion carried.

Brush cutting and spraying not to exceed $8,000.00 to be contracted with Angelica Tile on Schultz Drive, Lark Road, Moriah Road, Mt. Pleasant and Van Buren Roads with a motion from John Kirchberg, seconded by John Kraus, Jr., all votes aye.

Patching of Mt. Pleasant from Hwy D to culvert, end of Jay Road, Forest Road by Rake and Minnig, East Salem by Rake, and Schaffer Road to be completed by Northeast Asphalt.


Letter of Intent submitted by Altine Hesebeck to create an approximate 3 acre residential parcel with the existing farmstead from the existing 40 acre parcel at N5475 East Salem Road in section 27.
Scott Steers Planning Committee Chairman stated that the committee would recommend approval of this land division as it is considered farm consolidation, however, they felt that the residential parcel should have the "Right to Farm" statement as a deed restriction and the remaining agricultural land to have an "Agricultural Use Only" restriction or a 5-year moratorium on any further land divisions. The Dodge County Staff Advisory Report prepared by Jesse Thyes stated that the proposed division is in conformance with the Town Land Use Plan, not in conformance with the County's Comprehensive plan, however, because the division is considered a farm consolidation the Staff recommends that this land division be approved.

A motion was made by John Kraus, Jr. that this proposed land division be approved with a "Right to Farm" statement recorded on the deed of the homestead parcel. Lucille Miller made a second to the motion. Call of votes: all aye, motion carried.

Letter of Intent submitted by John Kirchberg to create an approximate 30 acre residential parcel with the existing homestead from the existing 40 acre parcel at N6750 Robin Road in section 9:
Chairman John Kirchberg abstained from the board and placed Supervisor Kraus, Jr. in charge of the meeting. Planning Committee Chairman Scott Steers stated that Planning Committee member Ken Schreiber abstained from committee because he is a renter of the land involved in this division. Mr. Steers stated that the committee agreed to approve this division with the "Right to Farm" statement recorded on deed as well as the recommendation that there be no further land divisions on the proposed parcel. County Staff Report prepared by Jesse Thyes stated that the division request is in conformance with the Town Land Use Plan as well as the County's Comprehensive plan therefore the staff recommends approval of this land division request.

A motion was made by John Kraus, Jr. to approve this land division request with a "Right to Farm" statement recorded on deed. Lucille Miller made a second to the motion, call of votes: John Kraus, Jr. aye, Lucille Miller aye, John Kirchberg abstained, motion carried.

Discussion on Town Hall repairs:
John Kirchberg stated that Diversified Construction stated that the problem with the ceiling tiles could be a result of improper air exchange in the ceiling and a heating and cooling specialist will need to see what could be done.

John Kraus Jr. stated that one quote to repair the floor tiles was $225.00. A motion to let John Kraus, Jr. hire the cheaper of the floor repair quotes, either from Professional Floor or Columbus Flooring was made by John Kirchberg, seconded by John Kraus, Jr., call of votes all aye, motion carried.

Marjorie Beilke stated that Wright Plumbing quoted the price for the three toilet fixtures to be around $500.00. The paint, supplies and caulking, with donated labor, would probably be around $150.00. A motion to hire Wright Plumbing to replace the fixtures was made by John Kraus, Jr., seconded by John Kirchberg. Call of votes: all aye, motion carried.

Discussion on City of Columbus Intergovernmental Agreement for Ambulance service:
The City of Columbus and participating surrounding towns have contracted with Heartline Medix for three years at the cost of $16,500.00 per month. Calamus Town share to be .0332982 % or $549.42 per month.

Report from Driveway Inspector:
Carole Garczynski stated the Tom Oppeneer told her that the driveway would be completed by today, May 13, 2003, and that it was not yet finished. She will be in contact with him regarding this violation.

Other Business:
John Kirchberg stated that Scott Gaddy of Advance Warning was in contact with him to inform John that the railroad crossing on Forest Road will be repaired.

Herb Braker asked John Kirchberg if he could be reimbursed $250.00 for the mowing of the town park last year on North Lost Lake. A motion was made by John Kirchberg to reimburse Herb Braker $50.00 for the cost of gas along with a letter stating that we are grateful for all he has done, but because he was not hired as an employee, and because he is not a subcontractor, we can not pay him for his labor. John Kraus, Jr. made a second to the motion. Call of votes: all aye, motion carried.

John Kirchberg state that he received a call from someone that wanted to purchase the house Herzberg is building on Moriah Road and he asked if he could park his semi truck there, because Moriah is posted 10-ton limit. It was decided that the tractor would be less than 10 tons and he could park that at that home, but that a trailer too would place him over the 10-ton limit and would not be allowed.
